Terms of Service

The standard operating terms and acceptable use commitments governing your use of the Node Command sovereign fleet management platform.

Last Updated: September 6, 2026 • Effective Date: September 6, 2026
Welcome to NC: By creating an account, enrolling host machines, or connecting AI clients via our Model Context Protocol (MCP) gateway, you agree to these Terms of Service. Please review them carefully.

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of Node Command, including services provided under https://nodecommand.app and https://mcp.nodecommand.app. By registering an account, installing the NC Host Agent, or connecting any AI client (OpenAI ChatGPT, Anthropic Claude, OpenCode, Cursor, etc.), you agree to be bound by these Terms.

2. Description of the Service

NC provides a secure, hosted, multi-tenant Model Context Protocol control plane enabling authorized AI models to interact with your explicitly enrolled Windows, Linux, and macOS host computers. Core functionality includes remote shell execution, bounded file inspection and manipulation, service status monitoring, and system snapshots.

3. Account Registration & Security

  • You must provide accurate and verifiable account information during registration (either directly or via our supported OAuth identity providers: Google, GitHub, GitLab, or Discord).
  • You are solely responsible for maintaining the confidentiality of your credentials, session tokens, and enrolled device private keys.
  • You must immediately notify NC of any unauthorized access, compromised device tokens, or security breaches affecting your workspace.

4. Acceptable Use Policy

You agree to use NC strictly in compliance with applicable local, national, and international laws. You agree NOT to:

  • Enroll machines that you do not own, control, or have explicit authorized permission to administer.
  • Use NC to deploy, execute, or propagate malware, ransomware, cryptominers, spyware, or unauthorized network reconnaissance tools.
  • Attempt to bypass multi-tenant boundaries, probe other tenants' machine IDs, reverse-engineer proprietary security daemons, or execute denial-of-service attacks against NC infrastructure.
  • Use automated tools or scrapers to abuse platform rate limits, bypass subscription tiers, or falsify device cryptographic proofs.

5. Remote Execution & User Responsibility

You retain full control and ultimate responsibility for commands issued by your connected AI agents. While NC provides granular host execution policies (read_only, standard, full), fail-closed permission gates, and 60-second Ed25519 authorization envelopes, NC does not evaluate the intent or business consequences of arbitrary scripts or commands you authorize your AI agents to execute.

6. Subscription and Billing Terms

Revision: 2026-10-23

Recurring subscriptions and payment. A paid Node Command plan renews automatically at the monthly or annual interval selected at purchase until renewal is canceled. The selected plan, billing interval, currency and applicable taxes are shown before payment. Paddle acts as merchant of record and handles payment collection, tax and payment documents under the applicable Paddle Buyer Terms. You approve the final purchase total in Paddle checkout. For an existing paid subscription change, review the Paddle-calculated amount and effective date in Node Command before confirming.

Starting service and upgrades. New paid access starts after successful provider confirmation. An eligible upgrade takes effect immediately and may create an immediate prorated charge calculated by Paddle. An immediate monthly-to-annual change starts a new annual billing period, as disclosed before confirmation. An unsuccessful payment or rejected change does not grant the requested upgrade. Existing valid account credit may settle an amount without a new card charge.

Downgrades and shorter billing commitments. A change to a lower tier, or from annual to monthly billing, takes effect at the end of your existing paid period. If a request combines changes, either reduction makes the whole request period-end. Until that date you retain the rights of the purchased plan. Ordinary deferred reductions do not generate an automatic prorated refund or account credit; the confirmed target plan is billed by Paddle for the next paid period. A plan-change request is not confirmed merely because a preview was displayed. Available transitions and their confirmed effective dates are shown in the billing interface.

Cancellation. Cancel renewal using the subscription controls in Node Command or the supported Paddle customer portal. Ordinary cancellation stops the next renewal and retains paid access until the existing paid period ends. We do not impose an automatic early-termination penalty or retrospectively recover an annual discount. Removing a device, disconnecting an agent or uninstalling software is not subscription cancellation.

Device limits and service continuity. Each plan has the features and device limits shown for that plan. A scheduled reduction does not reduce your current paid rights before its effective date. When a lower tier becomes effective, devices above its limit may be restricted under the existing plan-limit rules; this is not deletion of device records/data or removal of an installed agent. Failed renewal is handled under the applicable payment-recovery and service-continuity rules, not treated as a successful paid renewal.

Refunds and mandatory rights. Ordinary cancellation or downgrade does not automatically create a prorated refund. This does not exclude or limit mandatory consumer rights, legally required refunds, remedies for qualifying defects, or Paddle's authority as merchant of record under its Buyer Terms and Refund Policy. Your agreement does not waive non-waivable withdrawal rights. A Paddle account credit is not a cash refund, and existing valid credits remain subject to Paddle's handling.

7. Service Availability & Modifications

We strive to maintain high availability and performance across our control plane. However, NC is provided on an "as-is" and "as-available" basis. We may occasionally perform scheduled maintenance, software upgrades, or modify tool definitions to enhance platform security and MCP specification compliance.

8. Limitation of Liability

To the maximum extent permitted by law, NC and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of business revenue, or host system downtime resulting from remote commands executed on your machines through connected AI clients.

9. Termination

We reserve the right to suspend or terminate your account or revoke device access immediately if you violate these Terms or engage in activities that threaten platform security, integrity, or third-party rights. You may terminate your agreement at any time by forgetting your enrolled devices and deleting your account; for active commercial subscriptions, cancel renewal in subscription settings prior to account deletion as described in Section 6.

10. Governing Law & Contact

These Terms shall be governed by and construed in accordance with the laws governing digital services and cloud infrastructure. For legal notices, inquiries, or enterprise agreement requests, please contact:
